CAPITAL PLEIN AIR 2025 TERMS AND CONDITIONS
These Terms and Conditions govern participation in the Capital Plein Air 2025 Festival (“the festival”). Registration for the Festival constitutes full acceptance of these terms by participants.
REGISTRATION INCLUSIONS
Registration for Capital Plein Air includes the following benefits:
- Access to workshops conducted by Featured Festival Artists (additional costs apply).
- Permission to paint at designated government and private properties included in the Pre-Festival Paint-Outs (Monday 21 April – Thursday 24 April), with maps and location painting profiles provided.
- Permission to paint on designated government and private properties within the festival footprint during the main Festival (Friday 25 April – Sunday 27 April). Participants must display their issued lanyard to identify themselves as registered Festival artists.
- Free artist parking in designated areas at Festival locations.
- Eligibility to display and sell up to two artworks on the Pre-Festival Paint Out wet wall, subject to size limits and prior stamping. Sold works may be replaced with new pieces painted during the pre-festival paint-outs or festival weekend.
- Eligibility to enter up to two artworks for the “Capital Plein Air Art Awards” in one of three categories: Open, Non-Professional, or Youth.
- Participation in the “2-hour Quick Draw Painting Competition” on Sunday, 27 April 2025.
- Free entry to artist demonstrations and presentations during the festival.
Conditions of Use for Festival Footprint
Location permits grant exclusive access to registered artists for painting within the festival footprint. Painting at these locations without official Festival registration is prohibited under the permissions granted by property owners.
ART AWARDS AND ELIGIBILITY
PRE-FESTIVAL PAINT OUT
Participants may submit up to two artworks created during the pre-festival paint-outs to be displayed for public sale on the wet wall. All artworks must adhere to the stamping requirements outlined below.
Capital Plein Air Art Awards
Participants may enter up to two stamped artworks for judging, subject to the following conditions:
Artwork Eligibility
- Stamping Requirement: Only blank substrates stamped by Festival officials are eligible for entry. Stamping is available daily at designated locations from 8:00 AM–10:00 AM. Additional stamping opportunities will be announced prior to the Festival.
- En Plein Air Rule: All submitted works must be completed outdoors without post-location touch-ups. Only original work created during Festival times and within the Festival footprint will be eligible.
- Photographic Proof: Artists are required to photograph their completed artwork in front of the scene where it was painted and submit the photograph as part of their award entry.
- Artworks created during workshops are ineligible for awards or prizes.
- Eligible artworks must be two-dimensional painted works (no sculptures or photography).
- Artworks must be framed or, for watercolours and pastels, presented with a mat.
Award Categories
Artists must select one of the following categories during registration:
- Open (Acquisitional): Open to all artists, judged alongside professionals and guest artists.
- Non-Professional: For artists aged 18 and over who wish to compete against other non-professionals.
- Youth: For artists aged 18 and under (parent/guardian consent required).
Submission Guidelines for Awards
- Artworks must be submitted by 4:00 PM on Saturday, 26 April 2025. Late submissions will not be accepted.
- Submitted artworks must remain on display until the awards ceremony on Sunday, 27 April. Approximately 3pm Saturday 26th April 2024
- Artists must include photographic proof of their artwork in situ as part of the submission for award judging.
- All artwork must include proper hanging mechanisms (D-rings, hooks, or string) and a label with the following details:
- Artist Name
- Title of Work
- Medium
- Price
- Contact Information
Commission and Payment
- A 25% commission applies to all artworks sold during the Festival.
- Payments to artists, minus commission, will be processed within 30 days of the Festival via bank transfer.
- Unsold artworks must be collected by the artist at the end of the festival unless prior arrangements have been made. Unclaimed works will be donated to a local charity.
CANCELLATIONS AND REFUNDS
- Registration Fees: Non-refundable.
- Workshop Fees:
- Cancellations more than 30 days before the event incur a 20% fee.
- No refunds for cancellations less than 30 days before the event; however, transfers to another participant are permitted.
- In the event of cancellation due to COVID-19 or other force majeure, the Festival may transition to a virtual format.
ARTWORK SALES
Artists may sell artworks created during the Festival at the following locations:
- Pre-Festival Paint Out wet wall display.
- Capital Plein Air Art Awards exhibition.
- Directly at their easel.
All sales conducted during the Festival, including private transactions, are subject to the 25% commission. Artists conducting private sales are required to remit commission payments to the organisers in good faith.
PHOTOGRAPHY AND MARKETING
By participating in the Festival, artists grant Capital Plein Air permission to use images of their artworks for future promotional and marketing purposes.
LIABILITY FOR ARTWORK
- Capital Plein Air will take reasonable care in handling and displaying artworks during the Festival; however, the organisers are not liable for any damage, theft, or loss of artwork during the Festival, including during exhibitions, sales, or transport.
- Artists are encouraged to arrange their own insurance coverage for their artworks if they deem it necessary.
BEHAVIOUR AND CONDUCT
- All participants are required to conduct themselves professionally, courteously, and respectfully towards other participants, organisers, volunteers, and the public during the Festival.
- Unacceptable behaviour, including but not limited to harassment, discrimination, or disruption, may result in removal from the Festival and forfeiture of fees.
- Artists are responsible for maintaining the cleanliness of painting locations and the appropriate handling of rubbish and respecting the property and privacy of all locations included in the Festival footprint.
JUDGING DECISIONS
- Judging decisions for the Capital Plein Air Art Awards are final and not subject to challenge, appeal, or negotiation.
- Participants are expected to respect the impartiality and professionalism of the judges.
SAFETY AND RISK
- Artists are responsible for their own safety and well-being at all Festival locations, including pre-festival paint-outs and within the Festival footprint.
- Participants must assess the risks of their surroundings and take appropriate precautions to ensure their safety, including but not limited to weather preparedness, safe use of materials, and awareness of their environment.
- The organisers of Capital Plein Air cannot be held responsible for any injuries, accidents, illnesses, or other risks encountered by participants during the Festival.
Additional Conditions
- All participants are responsible for their own transportation, accommodation, and materials.
- The Festival reserves the right to alter or amend these terms as necessary. Updates will be communicated to registered participants.
